Selling an owner-built property in Victoria?
S137B Reports (Owner-Builder Reports)
Owner-builders in Victoria are legally required to provide a Section 137B Defects Report when selling their property. Our qualified inspectors thoroughly review your construction work, document any defects, and provide a compliant report suitable for inclusion in your Section 32 Statement.
This essential report protects both seller and buyer by clearly outlining the condition of all owner-built works.
What is a Section 137B report?
Section 137B of the Building Act 1993 (Vic) sets out obligations for owner-builders who sell their property within six years and six months of completing domestic building work. One of those obligations is providing the buyer with a defects report prepared by a suitably qualified person before the contract is signed. The report is usually included with the Section 32 vendor statement.
Depending on the value and type of work, owner-builders may also need domestic building (home warranty) insurance. Your conveyancer or solicitor can confirm exactly what applies to your sale.
What the report covers
We inspect the owner-builder works (for example an extension, renovation, deck, garage, pool surround or a whole new home) and document any defects, incomplete work and deterioration, with photos and clear descriptions a buyer can understand.
Timing your report
Because the report must be provided before the buyer signs, order it early in your sale campaign so it’s ready for your Section 32. Reports should be recent, so check the timing requirements with your conveyancer if your campaign runs for several months.
Frequently Asked Questions
Do I need a 137B report if I’m selling within 6 years?
Generally yes. If you carried out domestic building work as an owner-builder and are selling within six years and six months of completion, the Building Act 1993 (Vic) requires a defects report to be provided to the buyer. Confirm the details with your conveyancer.
What happens if I don’t provide a 137B report?
Failing to meet the section 137B requirements can give the buyer the right to end the contract, and may expose the vendor to penalties. It’s important to have the report ready before the contract is signed.
Who can prepare a 137B defects report?
The report must be prepared by a suitably qualified person, such as a registered building inspector or practitioner. PrimeCheck’s qualified inspectors prepare reports suitable for inclusion in your Section 32.
How much does a 137B report cost?
Cost depends on the scope of the owner-builder works. Contact us with details of the work for a quote before you book.
